This Privacy Policy explains how Amalgam Partners collects, uses, discloses, and protects information in connection with 360Analytics (the "Service"). This Policy applies to Customers, Authorized Users, and visitors to our website. It should be read together with our Terms of Service.
This Policy is governed by, and should be interpreted consistent with, the laws of the State of New York.
1. Information We Collect
1.1 Information You Provide. When you register for or use the Service, we collect information such as: your name, business email, company name, job title, billing information, and any information you submit through support requests or forms.
1.2 Information from Connected Platforms. When you connect a third-party platform (such as TikTok) to your 360Analytics account, we access and retrieve data made available through that platform's API pursuant to the authorization you grant (typically via OAuth), which may include:
Account and profile information (e.g., username, follower/following counts, profile metadata);
Content performance data (e.g., video views, likes, comments, shares, watch time);
Audience and engagement analytics associated with your connected account;
Advertising performance data, if you connect ad accounts.
We only access data made available by the Connected Platform's API under the scopes you authorize, and only for the purpose of providing the Service to you. We do not control what data a Connected Platform makes available or how accurate it is.
1.3 Usage and Device Data. We automatically collect information about how you use the Service, including log data, IP address, browser type, device identifiers, pages viewed, and timestamps, typically through cookies and similar technologies.
1.4 Information from Authorized Users. If your organization adds Authorized Users, we collect their name and email address to create and manage their access.
2. How We Use Information
We use collected information to:
Provide, operate, and maintain the Service, including retrieving and displaying analytics from Connected Platforms;
Authenticate accounts and manage access and permissions;
Process payments and manage billing;
Communicate with you about the Service, including updates, security notices, and support;
Monitor, troubleshoot, and improve the Service's performance and reliability;
Detect, investigate, and prevent fraud, abuse, or violations of our Terms of Service or a Connected Platform's terms;
Comply with legal obligations.
We do not sell personal information, and we do not use data retrieved from Connected Platforms (such as TikTok) for purposes beyond providing the Service to you, except as you separately authorize or as required by law.
3. How We Share Information
We do not sell your personal information. We may share information as follows:
Service Providers. With vendors who perform services on our behalf (e.g., cloud hosting, payment processing, customer support tools), under confidentiality and data protection obligations.
Connected Platforms. With the third-party platform itself, to the extent necessary to authenticate and retrieve the data you've authorized (e.g., sending your access token to TikTok's API to request analytics data).
Legal Compliance. When required to comply with a law, regulation, subpoena, or governmental request, or to protect the rights, property, or safety of Amalgam Partners, our users, or others.
Business Transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
With Your Consent. In any other circumstance where you direct us to share information.
4. Data Retention
We retain information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Data retrieved from Connected Platforms is retained until you disconnect the platform and request deletion, or until your account is closed, subject to reasonable operational backup periods.
5. Data Security
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, or destruction, consistent with our obligations under the New York SHIELD Act and other applicable law. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If we experience a security breach affecting your personal information, we will notify affected individuals and any required regulators in accordance with applicable law.
6. Your Choices and Rights
6.1 Access and Correction. You can review and update your account information directly within the Service, or by contacting us at contact@amalgampartners.com.
6.2 Disconnecting Platforms. You may disconnect a Connected Platform (such as TikTok) at any time in your account settings, which stops further data retrieval from that platform.
6.3 Deletion. You may request deletion of your account and associated data by contacting contact@amalgampartners.com. We will delete or anonymize your information unless we are required or permitted to retain it (e.g., for legal, tax, or security purposes).
6.4 Marketing Communications. You may opt out of non-essential marketing emails using the unsubscribe link in those emails. You will still receive essential service communications (e.g., security or billing notices).
6.5 State-Specific Rights. Depending on where you or your Authorized Users are located, you may have additional rights under state privacy laws (for example, California, Colorado, Connecticut, Virginia, or other states with comprehensive privacy statutes), such as the right to access, delete, or opt out of certain uses of personal information. 7. Children's Privacy
The Service is intended for business use and is not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us at contact@amalgampartners.com so we can address it.
8. Third-Party Platforms
The Service integrates with third-party platforms, such as TikTok, at your direction. Your use of those platforms, and any data they collect independently of the Service, is governed by their own privacy policies and terms. We encourage you to review TikTok's (and any other Connected Platform's) privacy policy before connecting it to 360Analytics. Amalgam Partners is not responsible for the privacy practices of third-party platforms.
9. International Data Transfers
If you access the Service from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to this transfer and processing.
10. Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Service, remember preferences, and understand usage patterns. You can control cookies through your browser settings; disabling cookies may limit some functionality of the Service.
11. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide reasonable notice (for example, via email or an in-product notice) before the changes take effect. The "Effective Date" above indicates when this Policy was last revised.
